Words with capitalized initials have meanings defined under the following conditions and apply equally whether used in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

  • Affiliate means an entity that directly or indirectly controls, is controlled by, or is under common control with a party.
  • Country refers to Gujarat, India.
  • Company (“We”, “Us”, or “Our”) refers to CreedAlly, EF-1108, Pehel Lakeview, Near Vaishnavdevi Circle, Gandhinagar – 382421.
  • Device means any device capable of accessing the Service, including computers, mobile phones, or tablets.
  • Service refers to the Website Maintenance Services, WordPress Care Plans, and related offerings provided via the Website.
  • Website refers to https://care.creedally.com/
  • License refers to a single subscription or maintenance plan applicable to one Website installation.
  • You means the individual or legal entity accessing or using the Service.

Acknowledgment

These Terms govern your use of the Service and constitute a legally binding agreement between You and the Company.
By accessing or using the Service, You confirm that:

  • You have read, understood, and agreed to these Terms.
  • You are at least 18 years of age.
  • You have the authority to bind your organization if acting on behalf of a company.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your data.

Scope of Website Maintenance Services

Our Website Maintenance Services may include, but are not limited to:

  • Core, theme, and plugin updates
  • Security monitoring and malware scanning
  • Performance optimization
  • Backups and uptime monitoring
  • Minor bug fixes and technical support (as per the selected plan)

Important:

Maintenance Services do not include:

  • New feature development
  • Design changes
  • Content creation or migration
  • Major refactoring or third-party conflicts

Any work outside the defined scope will be quoted separately.

License & Website Usage Policy

Single Website License

Each maintenance plan or license is valid for one (1) Website installation only.

Multisite & Multiple Websites

  • If your setup includes a WordPress Multisite, each individual site within the multisite network is considered a separate Website.
  • Each site requires its own active license.
    • Example: If your multisite contains 3 active sites, you must purchase 3 separate licenses.

Failure to disclose multisite or multiple websites may result in:

  • Suspension of services
  • Requirement to upgrade or purchase additional licenses
  • Termination without refund in case of misuse

Client Responsibilities

You agree to:

  • Provide accurate access credentials and information
  • Maintain valid hosting and domain services
  • Inform us of major changes made by third parties
  • Take responsibility for content legality and compliance

We are not responsible for issues caused by:

  • Third-party plugins/themes
  • Hosting limitations
  • Unauthorized access by external parties
  • Changes made without our knowledge

Third-Party Services

Our Service may rely on or integrate with third-party tools, plugins, hosting providers, or APIs. We do not control or guarantee the availability, functionality, or security of such services.

You acknowledge that the Company shall not be liable for damages arising from third-party services. All the third-party plugins, themes or any other services will be purchased by you.

Termination

We reserve the right to suspend or terminate access to the Service immediately, without prior notice, if:

  • These Terms are breached
  • Licenses are misused
  • Payments fail or are reversed
  • Malicious or unlawful activity is detected

Upon termination, all access to the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amount paid by You for the Service.
  • We shall not be liable for indirect, incidental, special, or consequential damages, including loss of data, revenue, business, or reputation.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind. We do not guarantee:

  • Error-free operation
  • Continuous uptime
  • Compatibility with all plugins, themes, or environments
  • Complete security immunity

Some jurisdictions may not allow certain warranty exclusions. In such cases, limitations apply to the fullest extent permitted by law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Gujarat, India, without regard to conflict of law principles.

Dispute Resolution

In case of any dispute, You agree to first attempt resolution by contacting the Company directly. Legal proceedings, if required, shall fall under the jurisdiction of courts in Gujarat, India.

Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Failure to enforce any right shall not constitute a waiver of future enforcement.

Translation Interpretation

If these Terms are translated into another language, the English version shall prevail in case of conflict.

Changes to These Terms

We may update these Terms at our discretion. Material changes will be communicated with reasonable notice where applicable. Continued use of the Service after changes implies acceptance.

If You do not agree with the revised Terms, You must discontinue use of the Service.
